The former personal attorney for Donald Trump has left her position as the US Attorney for New Jersey. This decision was prompted by a judicial decision that questioned her legal standing to serve.

Official Departure

The head of the Justice Department, Pam Bondi, accepted her stepping down on Monday. In a statement that the judicial decision made it impossible for Habba to lead the department effectively.

"But do not mistake following the order as giving up," Habba stated. "The effort will now stretch across the country."

Court Ruling

The departure follows closely on a judicial panel determined that she had been serving in violation of the law as the federal prosecutor. This ruling is expected to impact many legal proceedings in the Garden State.

The appellate judges ruled that a temporary posting that did not receive Senate approval violated the statute on vacant positions.

Next Steps and Responses

Bondi said that she will stay on at the DOJ as a senior adviser. They intend to challenge the decision of the ruling, in the hope of achieving a overturned decision.

In a statement, Bondi argued that judges "should not be able to countermand the executive's selection of attorneys entrusted with carrying out the fundamental role of the presidency of prosecuting crime."

The attorney general praised Habba's record and pointed out that during her run, the Newark saw a 20% reduction in crime. It was also reported that the southern city of Camden had its initial homicide-free summer since 1974 free from homicides.

Background and Previous Role

The 41-year-old attorney, was initially recruited to Trump's personal legal team in 2021. She later defended Trump in his business records case in 2024, leading to his conviction on 34 counts of document fraud.

Before Habba took on the top New Jersey post, Trump had announced he was appointing her as his White House advisor in a potential future term, calling the lawyer as a steadfast ally and a relentless legal advocate.
